Civil Subpoena Policy
Effective October 17, 2026
This Civil Subpoena Policy governs subpoenas, court orders, depositions by written questions, and other legal process issued in civil litigation in which MultiTEL LLC or VoiceWire, a MultiTEL LLC service (collectively, "MultiTEL"), is a non-party and Customer or communications records are requested ("Third-Party Civil Process"). It does not govern criminal, governmental, emergency, or law-enforcement requests.
1. MultiTEL's service relationships
MultiTEL provides a limited range of retail communications services directly to Personal/Consumer, Developer & Automation and Business subscribers, including mobile/eSIM, telephone-number, voice, messaging, hosted PBX, and related services. MultiTEL also provides communications services to carriers, communications providers, resellers, and platforms that serve their own downstream subscribers.
Record availability depends on the relationship applicable to the target number and relevant period:
- Direct MultiTEL subscriber. When MultiTEL directly serves the end user, MultiTEL may possess subscriber identity, account and contact information, account classification and verification records, billing and payment records, service and emergency-service addresses, assigned numbers, mobile/eSIM or SIM identifiers, service configuration, support records, and usage records, depending on the Service and retention period.
- Provider/reseller downstream subscriber. When MultiTEL's direct Customer is another communications provider or reseller, that Customer generally controls the downstream subscriber relationship. MultiTEL may possess the provider/reseller's identity and network or service records, but may have little or no downstream subscriber identity, billing, device, address, or account information. Such records ordinarily should be requested from the provider/reseller identified by MultiTEL.
A number may move between Customers or service models. Requests must identify the target number and a specific date range so MultiTEL can determine the applicable relationship.
2. Scope and availability of records
MultiTEL will search for records reasonably identifiable from a valid and properly served request. Records vary by Service, configuration, routing, account relationship, and retention period. The fact that a number uses a MultiTEL numbering, routing, messaging, or network resource does not establish that MultiTEL directly serves the end user or possesses every category of requested information.
MultiTEL may object to requests that assume a direct subscriber relationship where the number was assigned to a provider/reseller, or that assume MultiTEL lacks retail records where MultiTEL directly served the subscriber.
3. Call detail, messaging, and data records
MultiTEL may be a primary or secondary source of call detail records ("CDRs") depending on the Service:
- For a direct MultiTEL subscriber, MultiTEL may possess CDRs or messaging metadata generated by the subscribed Service, subject to configuration and retention.
- For a provider/reseller downstream subscriber, MultiTEL ordinarily carries only the portion of traffic routed through MultiTEL. The provider/reseller may hold the more complete subscriber and traffic record.
- MultiTEL may have no record of communications that did not traverse or use a MultiTEL Service.
Requests for CDRs, messaging metadata, data-session records, or archived records may require technical scoping, a protective order, additional time, and an Individual Case Basis fee. Requests should identify the target number, direction, date, time with time zone, and a narrow interval.
4. Communications content
MultiTEL generally routes communications and may not retain message bodies, call audio, voicemail, email, attachments, or other content unless the Customer enabled a Service or feature that stores it. MultiTEL will not create records that do not exist and will object where production is prohibited, unduly burdensome, disproportionate, or requires disclosure beyond valid legal authority. Content and similarly sensitive records may require heightened legal process and a suitable protective order.
5. Service of Third-Party Civil Process
MultiTEL does not consent to service by email or facsimile. Third-Party Civil Process must identify MultiTEL LLC, include the applicable processing fee where permitted, and be served on MultiTEL's registered agent or by U.S. Mail, overnight delivery, or courier at:

After physical delivery, tracking details may be sent to legal@multitel.net using the subject "Civil Process Tracking Details - [Case Name and Number]." Do not attach the subpoena to that tracking email. Sending tracking information does not constitute service or waive an objection.
6. Required request information
A request should include:
- the issuing court, case name and number, parties, and applicable authority;
- the target telephone number, account identifier, or other identifier known to MultiTEL;
- a specific date range and time zone;
- separately stated record categories tailored to the likely service relationship;
- the production due date and production contact email;
- any required consumer notice, consent, or protective order; and
- the applicable processing fee or legal authority prohibiting or limiting that fee.
Requests based only on a person's name, service address, IP address, SIM identifier, or device identifier may be impossible to locate if MultiTEL's direct Customer was a provider/reseller and did not supply that downstream information.
7. Customer notice and protective orders
Unless prohibited by law, court order, or a valid contractual or emergency exception, MultiTEL may notify the direct MultiTEL Customer whose information is requested. For provider/reseller service, that notice ordinarily goes to MultiTEL's provider/reseller Customer, which is responsible for its downstream relationship. For direct retail service, notice may go to the affected Personal/Consumer or Business subscriber.
MultiTEL may require a court-approved protective order before producing CDRs, messaging metadata, mobile/eSIM or SIM identifiers, emergency-service addresses, precise service-location information, content, or other sensitive records. The order should restrict access and use to the litigation and protect third-party confidential information.
8. Processing time
MultiTEL generally requires up to 45 business days after receipt of valid process, required fees, sufficient identifiers, and any required protective order. Additional time may be necessary for archived data, broad requests, multiple systems, technical restoration, customer notice, objections, or extraordinary circumstances. Narrow, correctly classified requests are processed more efficiently.
9. Processing fees
Where permitted, MultiTEL requires advance payment by check payable to "MultiTEL." The standard fee for requests limited to identifying the applicable direct Customer is:
- one or two target numbers: $50;
- three to five target numbers: $75;
- six to nine target numbers: $100; and
- ten or more target numbers: Individual Case Basis quote.
An Individual Case Basis fee applies to CDRs, messaging or data records, archived records, extensive research, content, direct-subscriber account files, or other requests imposing material burden or expense. Before requesting those records, contact legal@multitel.net for an estimate without attaching unserved legal process. If applicable law prohibits or limits reimbursement, the serving party must identify that authority.
10. Objections and unavailable records
MultiTEL may object to process that is invalid, improperly served, illegible, untimely, overbroad, disproportionate, unduly burdensome, technically infeasible, privileged, confidential, inconsistent with applicable privacy or communications law, or unsupported by required fees or protective safeguards. MultiTEL may state that no responsive records exist where a record was never collected, was not retained, is held by a provider/reseller, or falls outside the identified Service and period.
MultiTEL will not release CPNI, account information, mobile/eSIM or SIM identifiers, emergency-service addresses, or other protected information without Customer authorization or valid legal authority.
11. Witness testimony
If testimony is required and applicable law does not set a fee, MultiTEL charges $300 per hour, including travel time, plus reasonable travel expenses, mileage at the then-current IRS rate, tolls, parking, transportation, lodging, and a $100 daily meal allowance. MultiTEL may require advance payment of one-half of the reasonably estimated amount.
12. Call traceback
For a narrowly identified call, MultiTEL may possess a record useful in tracing traffic between providers. A traceback request should identify the calling and called numbers, exact date and time with time zone, duration, and the provider that identified MultiTEL as the adjacent carrier. MultiTEL records may reflect spoofed or blocked caller information received from an upstream network and may identify only that upstream provider. Traceback research may require an Individual Case Basis fee and additional time.
13. Governmental, criminal, and emergency requests
This policy does not authorize service of criminal process, governmental demands, national-security process, or emergency disclosure requests. Government and law-enforcement personnel should use MultiTEL's designated law-enforcement procedures. MultiTEL evaluates emergency requests under applicable law and may require verification of the requester's authority and the nature of the emergency.
14. No waiver
Receipt, correspondence, partial response, or discussion does not waive MultiTEL's objections, rights, privileges, service requirements, or right to require fees and protective safeguards. This policy does not constitute legal advice to a requesting party and does not expand MultiTEL's legal obligations.
